Terms of Service

These terms are an agreement between you and The Beautiful Company II, LLC (“Lifthoff”, “we”, “us”) covering your use of lifthoff.com and the Lifthoff service. By creating an account or using Lifthoff, you agree to them and to our Privacy Policy. If you use Lifthoff for a business, you confirm that you’re allowed to agree on its behalf, and these terms apply to that business too.

Lifthoff is a discovery platform. Creators and businesses publish products, apps, games, software, services and ideas; people discover them, follow them and show interest.

Lifthoff doesn’t sell, host or deliver the products listed here. When you click “Get it”, you go to the creator’s own site or store. Any purchase you make there is between you and that creator, under their terms. We aren’t a party to it and we aren’t responsible for it.

You must be at least 13 years old, or older if your local law requires it. To buy the business plan, you must be old enough to form a binding contract where you live. You can’t use Lifthoff if we’ve previously banned you, or if the law doesn’t allow you to.

• Give accurate information, and keep it up to date.
• Keep your password safe. You’re responsible for what happens on your account.
• Tell us straight away at team@lifthoff.com if you think someone else has accessed it.
• Each account can run one business profile. Don’t impersonate a person or brand you don’t represent.

• Price: publishing on Lifthoff requires the business plan, which is $19 per month (plus any applicable taxes). Drafts are always free, and browsing is always free.
• Automatic renewal: your plan renews every month and is charged to your payment method through Stripe until you cancel.
• Cancelling: you can cancel any time from Billing in your dashboard. You keep publishing until the end of the period you’ve paid for, and your plan won’t renew after that.
• Refunds: payments aren’t refundable, including for partly used months, except where the law requires otherwise.
• Failed payments: if a payment fails, Stripe retries it for a while and your products stay live. If it still doesn’t go through, your plan ends.
• When a plan ends, your published products are hidden from the public. We don’t delete them: they come back as they were if you subscribe again.
• Price changes: we’ll tell you at least 30 days before a new price applies to you, so you can cancel first if you don’t want to continue.

Stripe processes all payments, and its terms also apply to them.

You own what you post: text, photos, logos, product details, campaigns and messages (“your content”).

So that Lifthoff can work, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, display and share your content on Lifthoff, and to show it when promoting Lifthoff (for example a product card in a social post or on our homepage). This licence ends when you delete the content or your account, except for copies other people have already shared and backups we keep for a limited time.

You confirm that you have the rights to everything you post, and that your listings are accurate, including prices, availability, release dates and what the product actually is.

Don’t use Lifthoff to post, list, link to or send:

• anything illegal, or products that are illegal to sell where they’re offered;
• weapons, drugs, counterfeit goods, stolen goods, or anything that promotes violence or self-harm;
• sexually explicit content, or any content that sexualises minors;
• hate, harassment, threats, or content targeting people for who they are;
• scams, misleading listings, fake reviews or fake demand, or products you don’t actually intend to offer;
• anything that infringes someone else’s copyright, trademark or other rights;
• malware, phishing, or links designed to trick people;
• spam, including bulk or unwanted messages and repetitive listings.

Also don’t: try to access accounts or data that aren’t yours; get around our security, rate limits or plan restrictions; scrape Lifthoff or collect people’s details in bulk; or disrupt the service.

• Campaigns connect businesses with promoters. You can discuss and agree a deal in Lifthoff messages, but Lifthoff doesn’t process payments between businesses and promoters. Any payment, free product or delivery is arranged directly between you. The deal is between the business and the promoter: we aren’t a party to it and don’t guarantee that either side keeps to it.
• Never ask a promoter to pay to take part in a campaign. Promoters: be wary of anyone who asks you to.
• Promoters must clearly disclose paid or gifted promotions where the law or the platform requires it (for example the FTC’s endorsement rules in the US).
• Use messaging respectfully. People can block you and report messages; we may review reported messages and act on them.

We may remove content, hide listings, or suspend or close accounts that break these terms or put people at risk. Where it makes sense, we’ll tell you why. If we close a business account for a serious or repeated breach, we won’t refund payments already made.

Copyright and trademark complaints: if you believe something on Lifthoff infringes your rights, email team@lifthoff.com with a link to it, what you own, and your contact details. We’ll review it and remove content where appropriate.

You can stop using Lifthoff any time. To delete your account, cancel any plan and email team@lifthoff.com. We may suspend or end your access if you break these terms, if we must for legal reasons, or if we stop offering the service. If we shut Lifthoff down entirely, we’ll give you reasonable notice and refund any period you’ve paid for but won’t be able to use.

Lifthoff is provided “as is” and “as available”. We don’t promise the service will always be available or error-free, or that listing on Lifthoff will bring you customers, sales or any particular result. We don’t check or guarantee products listed by creators, the information in their listings, or what happens on their stores. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, Lifthoff won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about Lifthoff is limited to the greater of what you paid us in the 12 months before the claim or US$100. Some places don’t allow these limits, so they may not all apply to you, and nothing here limits liability that can’t legally be limited.

If someone brings a claim against us because of your content, your products, your deals with other users, or your breach of these terms or the law, you agree to cover our reasonable losses and costs, including legal fees.

We may update these terms as Lifthoff changes. If a change is significant, we’ll tell you by email or with a notice on Lifthoff at least 14 days before it takes effect. If you keep using Lifthoff after that, you accept the new terms. If you don’t agree, stop using Lifthoff and cancel your plan.

These terms are governed by the laws of the State of Nevada, United States, and disputes will be handled by the courts there, unless the consumer law where you live gives you the right to bring a claim in your own courts under your own law.
